Named 2023 Litigator of the Year by The American Lawyer, Enu is a nationally recognized trial lawyer with significant expertise in commercial and governmental litigation in the health care and financial services areas. In those areas, among others, Enu has over 25 years of experience defending government investigations, including those involving the False Claims Act. Enu is a longtime member of the Firm’s Executive Committee.

The Legal 500 notes that clients report Enu Mainigi is “who you want thinking and talking on your behalf before a judge or a jury.” She is “fantastic and very strong in oral advocacy, among other things.” The National Law Journal has twice recognized Enu as a Winning Litigator (2023, 2020), highlighting lawyers who “tackled some of the most widely watched cases of the year.” Enu was recognized as 2023 Litigator of the Year by The American Lawyer, after having been selected as a finalist for the award in 2020 and 2022. She has been named an “MVP” multiple times by Law360 in the areas of Health Care (2017, 2019, 2021), Trials (2023), and Banking (2024). And The National Law Journal has recognized Enu as a Trailblazer in both Class Actions (2023) and Health Care Law (2019). Benchmark Litigation has on multiple occasions named Enu a “Local Litigation Star” and a “National Litigation Star” in the area of white-collar crime and investigations, and among the “Top 250 Women in Litigation.” She has been recognized as a BTI Client Services All-Star.

Clients turn to Enu for their most important matters in a wide range of  areas. Recent examples include:  

Trials: In the last three years alone, Enu has first chaired seven matters that went to trial or arbitration, including for Fifth Third Bank, Bank of America, Cardinal Health and CVS in their most important trials. Enu achieved unqualified victories in all four of these matters that went to verdict, and in the three that resolved during trial, Enu achieved settlement results that were not attainable prior to the start of trial. In 2023, Enu won a jury trial for Fifth Third Bank in defending against a certified class action concerning one of the bank’s consumer products. In 2022, Enu won a landmark 3-month-long opioid trial in West Virginia federal court in the first opioid matter in the country to proceed to trial against wholesale distributors, resulting in a complete defense verdict for Cardinal Health. In 2021, Enu won a certified consumer class action jury trial for CVS Health in the Northern District of California that resulted in a complete defense verdict, a win that was later affirmed by the U.S. Court of Appeals for the Ninth Circuit. And in 2019, Enu and her team scored a major victory on behalf of CVS in a jury trial proceeding against the Texas Attorney General that could have resulted in CVS’s exclusion from Texas Medicaid, winning instead a directed verdict after a several-week trial where the state alleged Medicaid fraud against CVS under the Texas equivalent of the False Claims Act. 

Government Investigations: A consistently significant part of Enu’s practice is the representation of a broad spectrum of corporate institutions and individuals in civil fraud and criminal investigations. She has led the defense of over 100 False Claims Act investigations, and Chambers notes Enu has a “tremendous record” in False Claims Act cases, earning her a Band 1 ranking in Chambers' inaugural False Claims Act Litigation rankings.  

State AG: Enu is well-known for her work representing various clients in investigations and litigation brought by state Attorneys General, including single jurisdiction and multi-state investigations. For example, as described above, Enu won a directed verdict against the Texas AG after a several-week trial where the state alleged Medicaid fraud against CVS under the Texas equivalent of the False Claims Act. As part of her ongoing representation of Cardinal Health in the nationwide opioid litigation, including lawsuits brought by more than a dozen states’ Attorneys General, Enu secured a highly favorable settlement after months of trial against the Washington AG. And she currently serves as lead counsel for CVS in matters brought by multiple state Attorneys General regarding the pricing of insulin products, and as lead counsel for a major multinational financial institution in multiple state AG investigations into the bank’s Environmental, Social, and Governance policies and how they affect the bank’s lending decisions.  

Health Care: Enu is actively sought out by large and small players in the healthcare industry to lead their high stakes, bet-the-company litigation. Over the last two decades,  Enu has garnered impressive victories in this area. These have often been the result of pragmatically litigating novel or difficult issues. Chambers noted that clients describe Enu as “extremely knowledgeable on the law and regulations, but also practical in getting to a solution.” As a result, Enu has developed an impressive stable of top health care companies as clients, including as lead counsel for health care companies such as CVS Health, Cardinal Health, and Aetna (as well as smaller health care companies) on their most high stakes cases. Enu is currently lead national counsel for Cardinal Health on all opioid-related matters – civil litigation and state AG – which are the highest stakes litigation ever seen by the industry.  
In addition to serving as lead counsel on significant matters for these companies, Enu often plays an advisory and strategic role to their senior legal and business leadership.  

Financial Services: Enu is sought out by major players in the financial services industry both for their major government investigations as well as for their high-profile litigation and trials. In the past two years alone, Enu has gone to trial for Fifth Third Bank and Bank of America in their most economically significant matters. In 2023, Enu won a jury trial victory for Fifth Third in a certified class action related to the bank’s cash advance product, and in 2022, Enu went to trial for Bank of America in New York, trying the last of BofA’s financial crisis cases and securing a favorable settlement for her client that had not been possible prior to trial. From 2013 – 2016, Enu led the representation of Bank of America against the SDNY involving the novel use of FIRREA related to mortgages associated with the financial crisis. The Second Circuit ultimately awarded the Bank a complete win. Enu also represents banks in significant matters involving government regulators including the CFPB and the OCC.  

In addition to serving on the Executive Committee, Enu serves as Chair of the firm’s False Claims Act and Qui Tam practice and Co-chair of its Health Care practice.
