The Supreme Court has closed out the October 2023 Term with several blockbuster administrative-law decisions that are receiving a great deal of news coverage, including Loper Bright Enterprises v. Department of Commerce and SEC v. Jarkesy. Those decisions have eliminated so-called Chevron deference—a doctrine under which courts afforded deference to administrative agencies’ interpretations of ambiguous statutes—and require agencies to proceed in federal court—not in administrative proceedings—to seek civil penalties. And these are not the only major administrative law decisions of the Term. Please join us for an overview of what to know about recent decisions, their practical consequences, and other developments on the horizon.

Sarah Harris has argued five Supreme Court cases and obtained one summary reversal, as well as arguing over a dozen cases in federal and state appellate courts. Sarah’s appellate cases have run the gamut of substantive areas, including constitutional law, administrative law, arbitration, antitrust, criminal law, and federal civil procedure. Before joining the firm, she served as Deputy Assistant Attorney General at DOJ’s Office of Legal Counsel and clerked for Justice Clarence Thomas. Sarah is widely recognized nationwide as a leading appellate advocate by Chambers USA, The National Law Journal, Law360, Benchmark Litigation, The Legal 500 and Bloomberg Law.
Libby Baird focuses on appellate and regulatory litigation in cases involving constitutional and Administrative Procedure Act challenges to agency action. Before joining the firm, Libby clerked for Justice Amy Coney Barrett.
