Partner Robert Van Kirk has authored a chapter in Practical Law Commercial Litigation titled “Contract Basics for Litigators: District of Columbia,” a Q&A guide to contract principles and breach of contract issues under District of Columbia common law. The guide addresses contract formation, types of contracts, general contract construction rules, how to alter and terminate contracts, and how courts interpret and enforce dispute resolution clauses in the District of Columbia. It also discusses the basics of a breach of contract action, including the elements of the claim, the statute of limitations, common defenses, and the types of remedies available to the non-breaching party.
