Williams & Connolly secured a holding from the U.S. Court of Appeals for the Third Circuit vacating the National Labor Relations Board’s new monetary remedy. On December 27, 2024, following oral argument by Sarah Harris, the unanimous court held that the Board exceeded its statutory power by ordering Starbucks to compensate two terminated employees for “all direct or foreseeable pecuniary harms.” That remedy, the court held, went well beyond the traditional remedy of backpay and reinstatement and violated the National Labor Relations Act.
