On November 2, 2023, the Ninth Circuit affirmed the dismissal of all claims against Intel in an MDL stemming from the disclosure in January 2018 of a new class of security vulnerabilities, with the initial variants of that class named “Spectre” and “Meltdown” by researchers. The disclosure sparked a flurry of suits that ultimately led to multidistrict litigation in the District of Oregon on a consolidated complaint alleging defects in Intel chips starting in 2006. After nearly five years of litigation and following oral argument before the Ninth Circuit on October 17, 2023, the Ninth Circuit affirmed the district court’s mid-2022 decision dismissing all claims with prejudice.
