On Tuesday, October 18, 2022, partner Ellen Oberwetter will be speaking on a panel titled “Avoiding Uncertainty and Inaction – how directors of near insolvent companies can protect those companies, their creditors and themselves” for the International Association of Restructuring, Insolvency & Bankruptcy Professionals (“INSOL”). The Webinar will address how directors of near insolvent companies can protect those companies, their creditors and themselves, including: what steps directors can take to bring the company out of the "zone of insolvency", perhaps by using local statutory non-terminal insolvency processes or by other means; and what directors can do to protect themselves if the restructuring fails and the company goes into a liquidation (or equivalent) process. The Webinar will address these issues primarily from the directors' point of view.
Ellen represents clients in complex civil litigation in courts and arbitrations around the country. She is a Co-Chair of the firm’s Arbitration practice group and Chair of the firm’s Bankruptcy Litigation practice group. In recent years, her primary areas of practice have included patent and licensing disputes, legal malpractice matters, and bankruptcy litigation.
